Terms of Service

1. Acceptance of terms

These Terms of Service (“Terms”) govern your access to and use of BhamaJobs (the “Platform”), operated by the team behind BhamaJobs (“we”, “us” or “our”) and available at jobs.bhama.app and its associated city portals.

By accessing, registering for or using the Platform, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, you must not use the Platform.

The Platform helps candidates find opportunities quickly. To do this, we collect and process the information you provide, as described in our Privacy Policy.

2. Definitions

• Candidate — an individual who accesses the Platform to seek employment, work or skills development.
• Organisation — an employer, business or other entity that posts an Opportunity or creates a Careers Page on the Platform.
• Careers Page — the public page an Organisation publishes on the Platform, showing its branding, information and Opportunities.
• Opportunity — a job, project, contract, internship or other work listing published on the Platform.
• Content — any information, text or material submitted to or made available through the Platform.
• User — any person who accesses or uses the Platform, whether or not registered.

3. Eligibility

The Platform is intended for adult users. An individual under the age of 18 may use the Platform only with the consent and supervision of a parent or lawful guardian. By using the Platform, you represent that you have the legal capacity to enter into these Terms and that you are not barred from doing so under any applicable law.

Where you use the Platform on behalf of an Organisation, you represent that you are authorised to bind that Organisation to these Terms.

4. Your account

Certain features of the Platform require you to create an account or sign in through a third-party authentication provider. You agree to provide accurate, current and complete information, and to keep it updated.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us promptly at the address in Section 23 if you become aware of any unauthorised use of your account.

You may not transfer your account to any other person, or maintain more than one account without our prior written consent.

5. Nature of the service

The Platform is an information and matching service. It enables Candidates to create a profile, view Opportunities that may be relevant to them, undertake skills development, and express interest in or apply for Opportunities.

We are not an employer, employment agency, recruitment consultant or labour contractor, and we are not a party to any employment, engagement or contractual relationship that may arise between a Candidate and an Organisation. Any such relationship is solely between those parties.

The Platform also provides tools for Organisations to publish a Careers Page, receive and review applications, and optionally use artificial-intelligence tools to help review them. We do not guarantee employment, engagement, income, interviews, responses, or any particular outcome. Any indication of suitability, match, readiness or recommendation presented on the Platform is informational only, is generated from information supplied by Users, and does not constitute a representation, endorsement or assurance by us.

6. No fees

Access to the Platform is provided to Candidates free of charge. We do not charge Candidates any registration fee, placement fee, subscription fee or commission of any kind.

Employer features are currently free during the pilot. We may introduce fees for Organisations in future and will give notice before doing so. We will never charge Candidates. We will never ask you to make a payment, deposit or transfer in connection with an Opportunity. If any person requests payment from you in connection with the Platform or an Opportunity found through it, that person is not acting on our behalf, and you should not make any payment. Such incidents may be reported to us at the address in Section 23.

7. Listings and applications

Opportunities published on the Platform are provided by Organisations or compiled by us. While we take reasonable care in reviewing listings before publication, we do not independently verify the registration, licensing, financial standing or hiring practices of any Organisation, and we make no representation as to the accuracy, completeness or currency of any listing.

Certain listings are identified on the Platform as illustrative samples. Such listings do not represent live vacancies, no Organisation is engaged in respect of them, and no application can be submitted against them.

Submitting an application does not create any obligation on the part of an Organisation to respond, interview, engage or employ you. Decisions in relation to an application rest solely with the Organisation concerned.

You should exercise the same care in relation to any Opportunity found through the Platform as you would with any other employment or work lead.

8. Organisations and Careers Pages

Employer features are currently offered to approved Organisations only, as an invite-only pilot. We may decline, suspend or remove any account, Careers Page or Opportunity at our discretion, including where it appears misleading, unlawful or unsafe.

If you create an account or Careers Page for an Organisation, you agree that:

• You are authorised to act for the Organisation and to hire on its behalf;
• You will publish only genuine vacancies that the Organisation intends to fill, with accurate titles, descriptions, locations and pay;
• The Organisation will not charge Candidates any fee to apply, be interviewed or be hired;
• The Organisation will comply with applicable law and will not discriminate on grounds such as caste, religion, gender, disability or place of birth;
• You have the right to use the name, logo and other material you publish; and
• Content on a Careers Page is public, and you are responsible for it. The page address cannot be changed once created, and we may change or reclaim an address that is misleading or infringing.

9. Applicant information and AI-assisted review

An Organisation that receives an application must use the applicant’s information only to assess that person for that vacancy, keep it secure, not sell or share it, not use it to send unrelated promotions, and delete it when it is no longer needed or when the applicant reasonably asks.

An Organisation may use artificial-intelligence tools to help review applications. If it does, it must use its own account and keys with the provider, keep those keys private, send only the information it needs, follow the provider’s terms, and make clear to applicants that AI may be used. It must treat any score or summary as advice only, make sure a person makes each hiring decision, never reject an applicant on an AI score alone, check results for errors and bias, and never use or infer protected characteristics. We do not guarantee the accuracy of any AI output and are not responsible for an Organisation’s decisions.

10. Resumes

You may add resume text to an application, either read from a file by your own device or pasted by you. You must have the right to share it, and it must not contain unlawful content. We may remove any content that breaches these Terms. The Organisation you apply to can read your resume text, as explained in our Privacy Policy.

11. Acceptable use

You agree not to:

• Provide false, misleading or fraudulent information, or impersonate any person or entity;
• Use the Platform for any unlawful purpose or in breach of any applicable law;
• Post or transmit any Content that is unlawful, defamatory, obscene, discriminatory, harassing or infringing of any third-party right;
• Use the Platform to solicit payment from, or advertise to, other Users;
• Interfere with, disrupt or attempt to gain unauthorised access to the Platform or any related systems;
• Use any automated means to access, scrape, copy or index the Platform or its Content; or
• Reproduce, resell or commercially exploit any part of the Platform without our prior written consent.

12. Your content

You retain ownership of the Content you submit to the Platform. You grant us a non-exclusive, royalty-free, worldwide licence to host, store, reproduce and display that Content solely for the purposes of operating and providing the Platform, including presenting your application to an Organisation where you choose to apply. Content an Organisation publishes on its Careers Page is visible to the public.

You represent and warrant that you have the right to submit the Content you provide, that it is accurate to the best of your knowledge, and that it does not infringe the rights of any third party.

13. Intellectual property

The Platform, including its software, design, text, graphics, learning materials and trade marks, is owned by us or our licensors and is protected by applicable intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for your own personal, non-commercial purposes.

No rights are granted to you other than those expressly set out in these Terms.

14. Third-party services and links

The Platform relies on third-party services for hosting, authentication and analytics, and may contain links to third-party websites or resources. We do not control and are not responsible for the availability, content, products, services or practices of any third party. Your use of a third-party service is governed by that party’s own terms and policies.

15. Privacy

Our collection and use of personal information in connection with the Platform is described in our Privacy Policy. By using the Platform, you acknowledge that you have read and understood that policy.

16. Disclaimers

To the maximum extent permitted by applicable law, the Platform is provided on an “as is” and “as available” basis, without warranties or conditions of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement.

We do not warrant that the Platform will be uninterrupted, timely, secure or error-free, that any defect will be corrected, or that any Content, listing or recommendation available through the Platform is accurate, complete or reliable.

17. Limitation of liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, income, opportunity, employment, data or goodwill, arising out of or in connection with your use of, or inability to use, the Platform.

Without limiting the foregoing, we shall not be liable for any act, omission, conduct or representation of any Organisation, Candidate or other User, including in relation to any recruitment process, engagement or employment.

Nothing in these Terms excludes or limits any liability which cannot lawfully be excluded or limited.

18. Indemnity

You agree to indemnify and hold harmless us, our officers, employees and agents from and against any claims, liabilities, damages, losses and expenses, including reasonable legal fees, arising out of or in connection with your breach of these Terms, your Content, or your misuse of the Platform.

19. Suspension and termination

You may stop using the Platform at any time and may request deletion of your account as described in our Privacy Policy.

We may suspend or terminate your access to the Platform, in whole or in part, with or without notice, where we reasonably believe that you have breached these Terms or applicable law, or where necessary to protect the Platform or other Users. Provisions which by their nature should survive termination shall do so, including Sections 9, 10, 13, 14, 15 and 18.

20. Changes to the Platform and these Terms

We may modify, suspend or discontinue any part of the Platform at any time. We may also revise these Terms from time to time. The revised Terms will be posted on this page with an updated date, and where the changes are material we will provide notice through the Platform. Your continued use of the Platform after the revised Terms take effect constitutes your acceptance of them.

21. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Subject to any applicable law providing otherwise, the courts at Lucknow, Uttar Pradesh shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Platform.

22. General

• Entire agreement — these Terms, together with the Privacy Policy, constitute the entire agreement between you and us in relation to the Platform.
• Severability — if any provision is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
• No waiver — our failure to enforce any provision shall not constitute a waiver of that or any other provision.
• Assignment — you may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations in connection with a merger, acquisition or transfer of assets.
• Force majeure — we shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control.
